Environment -New provisions regarding recycled plastic intended to come into contact with food

To comply with European Union legislation in this area, the Decree of 23 April 2024 amends article R412-38 of the Consumer Code regarding materials and objects made from recycled plastic intended to come into contact with food.

Thus, references to the repealed Regulation (EC) No 282/2008 are replaced by references to Regulation (EU) 2022/1616.

This new regulation establishes uniform rules regarding the decontamination of recycled plastic materials and objects intended to come into contact with food (packaging, containers, etc.). This framework therefore creates confidence among consumers and the agri-food sector with regard to recycled plastic.

The new provisions include requirements regarding:

  • materials and objects made from recycled plastic;
  • documentation and labelling;
  • new recycling technologies;
  • recycling facilities that use new technology;
  • monitoring and reporting contamination levels;
  • the authorization of a recycling process;
  • the summary conformity check sheet and verification of the operation of a decontamination facility;
  • to the declaration of conformity.

Failure to comply with these provisions is punishable by a fine of Maximum €1,500 (fine of 5e class). In case of recidivismthis amount will be increased to Maximum €3,000.
